These Terms and Conditions apply to all individuals using the Website, booking services, and accessing any free or paid resources & products.

All content on this Website, including text, images, educational resources, and e-books, is protected by copyright law and is the property of Focus K9. Users are not permitted to copy, reproduce, distribute, or republish any content without prior written consent from the Company. The resources provided are for educational purposes and should be used at the user's discretion.

2.General Store Terms
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence or that you are the age of majority in your state or province of residence and have given us consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose, nor may you, in using the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms, viruses, or any code of a destructive nature. Any breach or violation of these Terms will result in the immediate termination of your Services.

3.General Conditions
We reserve the right to refuse Service to anyone for any reason at any time. You understand that your content (excluding credit card information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to the technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, the use of the Service, or access to the Service, or any contact on the website through which the Service is provided, without express written permission from us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

4.Liability
I, as the legal owner or agent of the enrolled dog(s), understand and agree that Focus K9 and its representatives, including Sydney Lemiski, are released from any liability for injury, illness, or damage caused to me, my pet, or third parties before, during, or after any training program, including in-home training, public park training, group classes, and socialization sessions. I assume full responsibility for my dog's behavior at all times.

Focus K9 is insured and qualified to provide dog training services but cannot guarantee the outcome of any training or behavior modification program. We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from the use of the Service will be accurate or reliable. You agree that from time to time, we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you. You expressly agree that your use of, or inability to use, the Service is at your sole risk.

The Service and all products and Services delivered to you through the Service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representations, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. In no case shall Focus K9, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility.

5.Safety
I acknowledge that behavioral risks are inherent in dog training, and that other dogs with behavioral issues may be present. I waive and release Focus K9 and Sydney Lemiski from any claims arising from injury or damage caused by other dogs or participants. I agree to disclose any known behavioral issues, bite history, or medical conditions before participating in any training session. I confirm that my dog is up to date on all required vaccinations (including rabies) and understand that even with vaccination, there is still some risk involved.

6.Termination of Services
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If, in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we may also terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

7.Cancellations/Rescheduling Services
Private training sessions, socialization classes, or drop-in classes may be canceled or rescheduled with a minimum of 48 hours' notice is required. For group courses (e.g., Calm & Confident, Trail Manners, Foundational Manners), a minimum of one week's notice is required. Private School and Transfer sessions can be rescheduled anytime before the start of the session.

8.Refund, Return, Credit & Exchange Policy

Services
Private training sessions, socialization classes, or drop-in classes may be canceled or rescheduled with a minimum of 48 hours' notice to receive a refund or credit. For group courses (e.g., Calm & Confident, Trail Manners, Foundational Manners), a minimum of one week's notice to receive a refund or credit. No refunds or credits are available once services have commenced.

To secure your spot in our Private School programs, a 25% deposit is required. This deposit is refundable up to one week prior to your scheduled start date. Once your program has commenced, no refunds will be available; however, credits may be issued. Individual Private School and Transfer sessions not included in a program can be rescheduled or canceled anytime before the start of the session for a full refund or credit.

Emergencies are dealt with on a case-by-case basis, and a refund may be issued minus a $50 administrative fee. Failure to provide the appropriate notice will result in the session being counted as completed and full fees charged.

Products

We’re committed to your satisfaction and offer a 30-day return policy. This means you have 30 days from receiving your item to initiate a return. For eligible items returned to us in new condition within 30 days, no restocking fee will be charged.

To qualify for a return, items must be in the same condition as received: unworn, unused, with tags attached, and in their original packaging. Digital ebook downloads are non-returnable.

Be sure to include a copy of the original packing slip or a note with your order number, name, and contact details, and indicate that you’re returning the item(s) for a refund.

Damages and Issues
Please inspect your items upon arrival and reach out immediately if they’re defective, damaged, or incorrect. We’ll promptly assess the issue and make it right. Note: we cannot offer a warranty or replacement for items damaged by chewing or other pet-related incidents.

 

Non-Returnable Items
Certain items are non-returnable, including digital products, custom orders, and personalized items. Please get in touch if you have questions about your specific item.

 

Exchanges
To exchange an item, return the original item for a refund, then place a new order for the desired item.

 

Refunds & Returns
Once we receive your returned items, we’ll inspect them for eligibility. Items deemed unsellable will be addressed with further arrangements.

Approved returns will be refunded to your original payment method within 10 business days. Please allow additional time for your bank to process the refund.

 

Credits
Credits are valid for one year from the purchase date.

9.Service Payment
Full payment is required 48 hours prior to the start of the service unless other payment arrangements are made in writing. Unpaid bookings may be canceled without notice. Clients are responsible for purchasing any training equipment recommended by the Company. Borrowed equipment must be returned at the end of the session; lost or damaged items will incur a replacement fee. All service charges must be paid within 30 days of receipt of the invoice, after which a 20% monthly interest rate will apply, and legal action may be taken for unpaid balances.

11.Medical Emergencies
If a medical emergency arises while Focus K9 is in charge of the dog and the owner is unavailable, the Company may take the dog to a veterinarian or emergency clinic at its discretion. The owner is responsible for any medical expenses and transportation fees, which must be reimbursed within 30 days.

12.Accuracy, Completeness, and Timeliness of Information
The Company is not responsible if information made available on this site
